Centrists Must Learn From the Tradition of Miranda or Suffer Its Consequence

A little remembered judicial fact is that the Rehnquist Court, in the year 2000, by a 7-to- 2 vote, declared the Miranda decision unconstitutional. But the court refused to endorse their findings, claiming that Miranda must stand because: the warnings, ‘you have the right to remain silent, etc.’, ”have become part of our national culture.” Therefore, even though it was proven ‘unconstitutional’, a 24 year old tradition was enough to overturn the foundation of our government. One must logically ask: Why is it that the “national culture” only applies to radically left causes? Why isn’t this same precedent used for school prayer, 2nd Amendment Rights, protection of the unborn, or the removal of everything “God” in society? For instance it is certain the founders used public prayer regularly and nobody seemed to object to Judeo Christian principles being taught in public schools for far greater than 24 years. The Ten Commandments themselves are embedded in stone right above the heads of these austere justices in the Supreme Court Building. They have resided there for many more than the Miranda litmus of 24 years. Moreover, public celebration of Christian Holidays and Judeo Christian ethic likewise far surpass the years established by Miranda. But perhaps the most egregious affront to the culture in decades has recently transpired in the cancelation of “flag folding” ceremonies at the graveside of veterans and soldiers killed in action. From now on should the family wish this traditional ceremony they must request it and in most cases provide the necessary personnel to carry it out? I must candidly ask: What greater honor is more steeped in our culture than this grave side ceremony? What greater comfort and memorial from a grateful country is there than the very flag which draped the heroes coffin? Rather than these families having to find people who will accomplish this ceremony in their time of bereavement, wouldn’t it make more sense to merely ask the family if they wished opt out of the ceremony? The action has been taken, largely because the Judeo-Christian God and the family have become Politically Incorrect. Each of the 13 folds is explained:
1st. Symbol of life.
2nd. Symbol of our belief in the eternal life.
3rd. In honor and remembrance of the veteran departing our ranks who gave a portion of life for the defense of our country to attain a peace throughout the world.
4th. Represents our weaker nature, for as American citizens trusting in God, it is to Him we turn in times of peace as well as in times of war for His divine guidance.
5th. A tribute to our country, for in the words of Stephen Decatur, “Our country, in dealing with other countries, may she always be right; but it is still our country, right or wrong.”
6th. Represents where our hearts lie. It is with our heart that we pledge allegiance to the flag of the United States of America, and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all.
7th. A tribute to our armed forces.
8th. A tribute to the one who entered in to the valley of the shadow of death, that we might see the light of day, and to honor mother, for whom it flies on Mother’s Day.
9th. A tribute to womanhood.
10th. A tribute to father.
11th. In the eyes of a Hebrew citizen, represents the lower portion of the seal of King David and King Solomon, and glorifies, in their eyes, the God of Abraham, Isaac, and Jacob.
12th. In the eyes of a Christian citizen, represents an emblem of eternity and glorifies, in their eyes, God the Father, the Son, and Holy Ghost.
13th. When the flag is completely folded, the stars are uppermost, reminding us of our national motto, “In God We Trust.”
If the Centrist majority is reticent to use the 2000 “Miranda 24 year tradition clause”, to preserve the culture, you can bet it will be used against them. I can picture it, after God has been removed from society, it will be decided in 24 years that it was unconstitutional to do so, but it has become part of America’s fabric, part of “national culture” so it must stand.
